You therefore agree that you shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in the Asimuth Terms. You also agree that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the Asimuth Terms.

  • If any provision or part-provision of the Asimuth Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph shall not affect the validity and enforceability of the rest of the Asimuth Terms.

We may make changes to these terms

We amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated on 19 October 2017.

We may make changes to our site

We may update and change our site from time to time to reflect changes to our products, our users' needs and our business priorities. We will try to give you reasonable notice of any major changes.

Our site is made available free of charge.

We are not responsible for websites we link to

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

Our responsibility for loss or damage suffered by you

Consumers: our site is not intended for consumer use and if you are acting in the capacity of a consumer you must cease to use our site immediately.

Business users:

  • We exclude all implied conditions, warranties, representations and other terms that may apply to our site or any content on it.
  • We shall not be in breach of the Asimuth Terms nor liable for delay in performing, or failure to perform, any of our obligations under the Asimuth Terms if such delay or failure result from events, circumstances or causes beyond our reasonable control.
  • We will not be liable to you for any loss or damage, whether in contract, tort (including, without limitation, negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    • use of, or inability to use, our site; or
    • use of or reliance on any content displayed on our site.
  • We will not be liable for any of the following (whether held to be direct, indirect, incidental, consequential, special or other forms of loss):

  • For the avoidance of doubt, nothing in our Asimuth Terms limits of excludes liability for:
    • death or personal injury;
    • fraud or fraudulent misrepresentations; or
    • any liability which cannot be lawfully limited or excluded.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. Which country's laws apply to any disputes?

These terms of use, their subject matter and their formation (including without limitation, and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Our trade marks are registered

“Asimuth" is a UK registered trade mark of Asimuth Limited. You are not permitted to use it without our approval, unless it is part of material you are using as permitted under 'How you may use material on our site' as referred to above.
